LIABILITY WAIVER, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT

In consideration of participating in yoga classes, instruction, or related activities on the Mercer Wellness Day (“Wellness Day”) provided by Root Adventures, LLC (“Company”), I agree as follows:

1. Acknowledgement and Assumption of Risk

I understand that the Wellness Day involve physical movement and exertion and carry inherent risks, including but not limited to: muscle strains, sprains, falls, injury, aggravation of pre-existing conditions, and, in rare cases, serious injury.

I acknowledge that instructors may provide guidance, but they are not infallible and may misjudge a participant’s abilities or physical condition. I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, that I may incur as a result of participating.

2. Medical Certification

I certify that I am physically able to participate in the Wellness Day activities and have no medical condition that would prevent safe participation, or I accept full responsibility for any risks associated with such condition. I agree to consult a physician if I have any concerns.

I understand that I am responsible for any medical costs incurred as a result of participation.

3. Release of Liability

To the fullest extent permitted by law, I release, waive, and discharge the Company and its owners, employees, instructors, and representatives (“Released Parties”) from any and all claims or liability for injury, loss, or damage arising out of my participation in the Wellness Day activities, including those caused by negligence.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or expenses (including attorney’s fees) arising from my participation or my actions during the Wellness Day activities.

5. Photo Release

I grant permission for the Company to use photographs or video of me taken during the Wellness Day activities for promotional and business purposes.

6. Governing Law

This agreement shall be governed by the laws of the State of Colorado. Any disputes shall be resolved in courts located in Denver, Colorado.

7. Acknowledgement

I have read and understand this agreement, and I voluntarily agree to its terms. I understand that I am waiving certain legal rights by registering and attending the Wellness Day activities.
